IIUSA has been hard at work responding to the EB-5 Reform and Integrity Act NPRM. At 358 pages, it covers virtually every aspect of how the EB-5 program is administered and is one of the most significant proposed rulemakings in the history of the program. The public comment period closes at the end of this month, and what happens between now and that deadline matters tremendously.
IIUSA has been engaged from the moment the rule was announced, and the August 12th webinar will cover where the association stands and what we are asking of members and stakeholders.
Why This Rulemaking Matters
This proposed rule is DHS’s attempt to build a comprehensive regulatory framework for the post-RIA program, and the decisions made through this process will shape how the EB-5 program operates for years to come.
The comment period is not a formality. Federal agencies are required to review and respond to substantive public comments, and a well-organized, well-reasoned industry response can influence the final rule.
How IIUSA Is Responding
IIUSA is conducting a thorough review of the proposed rule, working to understand the full scope of the DHS proposals, identifying areas where the industry’s perspective needs to be heard, and developing a coordinated response that reflects the breadth and depth of our membership.
Specifically, our Public Policy Committee divided into key working groups, each tackling the separate elements of the NPRM. Naturally, in addition to processing and understanding the NPRM, the working groups are drafting the necessary comments that speak directly and substantively to the provisions impacting regional centers, investors, and service providers.
Your Voice is Needed
We need your help in two ways.
First, if you are an IIUSA member you will likely soon receive an important data collection survey. Please take it seriously and do your best to provide as many thorough answers as possible. For the first time, USCIS (through the NPRM) has solicited information from the industry, and this is our opportunity to provide it. Your responses will enable IIUSA to ensure our comments are properly contextualized making our comments more meaningful and therefore more impactful.
Second, while IIUSA will be submitting its own association comments, individual and organizational comments from across the EB-5 community also carry significant weight! The more voices that engage in this process, regional centers, immigration attorneys, development professionals, banks, and other stakeholders, the stronger the collective signal to DHS that the EB-5 community is paying attention and has thoughtful perspectives to contribute.

The Bottom Line
The EB-5 program has survived difficult moments before because our community has shown up when it mattered most. The comment period on this rule is one of those moments. IIUSA has worked hard to ensure the EB-5 industry has a seat at the table, and we want every member of our community at the table with us.
