December 2023 Visa Bulletin: No Change for EB-5

 

The monthly Visa Bulletin for December 2023 was recently released by the U.S. Department of State. Following noteworthy developments in October, as detailed here, the latest bulletin indicates that the cut-off dates for the EB-5 visa category will remain unchanged in December.

 

EB-5 FINAL ACTION DATES (CHART A)

In the December Visa Bulletin, the final action dates for EB-5 visa applicants were disclosed as follows:

  • Applicants associated with unreserved EB-5 visa categories:
    • China: October 1, 2015 (No Change);
    • India: December 15, 2018 (No Change);
    • All Other Countries: “Current”;
  • Applicants associated with an EB-5 project within the reserved EB-5 visa categories:  
    • All Countries: “Current”;

EB-5 DATES FOR FILING (CHART B)

In December, the filing dates for all EB-5 applicants will remain “current,” with the exception of applicants born in China or India under the “unreserved” visa categories. The filing dates for these applicants will stay the same as those in the previous visa bulletin, specifically January 1, 2017, for Chinese nationals and April 1, 2022, for Indian applicants.

Under the 2023 EB-5 Reform and Integrity Act, eligible EB-5 investors with a priority date earlier than the Dates of Filing can take advantage of concurrent filing for their I-526E petition and adjustment of status application.
