The U.S. Department of State – Bureau of Consular Affairs has published the January 2020 Visa Bulletin (View PDF). The EB-5 Regional Center category has been listed as “U” meaning unauthorized for issuance.
FINAL ACTION DATES
The final action dates for the EB-5 Regional Center category has been listed as unauthorized due to the current continuing resolution (CR) under which EB-5 is currently authorized, expiring after December 21, 2019. However, Congress has passed legislation that will reauthorize the EB-5 Regional Center Program through September 2020, which is expected to be signed by the President shortly.
When legislation is signed the final action dates would immediately become “Current” for January for all countries except mainland born China, which would be subject to a November 22, 2014 final action date; India, which would be subject to a May 1, 2018 final action date; and Vietnam, which would be subject to a December 8, 2016 final action date.

DATES FOR FILING
In January 2020, USCIS will continue to accept dates for filings for adjustment of status (“AOS”) applications from employment-based categories (including EB-5).
As indicated on the January Visa Bulletin, while the date for filing for Chinese EB-5 applicants is May 15, 2015, it remains as “Current” for all other countries including Vietnam and India. That means, eligible EB-5 visa applicants from all countries, except for mainland China, may file an AOS application as soon as they receive an approval of their I-526 petition. For eligible EB-5 applicants from China, they may file an AOS application to USCIS as long as their priority date is earlier than May 15, 2015.
