This week, USCIS published the quarterly statistics for the third quarter of FY2026, including data on pre-RIA Form I-526 petitions and post-RIA Form I-526E (Regional Center investors) and Form I-526 (Direct EB-5 investors) petitions. The latest data show continued strength in EB-5 investor demand and capital formation, alongside slowing I-526E adjudications, declining approval rates, and an increasing pending inventory. Key takeaways from IIUSA’s data report include:
- EB-5 investor demand remained strong. USCIS received a total of 1,665 EB-5 cases in Q3 FY2026, including 1,599 I-526E petitions and 66 I-526 petitions. Nearly 20,000 post-RIA investor petitions have been filed since the enactment of the RIA in 2022. An estimated $4.18 billion in EB-5 capital was raised during the first three quarters of FY2026.

- India and China were virtually tied as the two largest EB-5 investor markets in FY2026. Amid continued growth in the Indian market, 1,977 petitions were filed by Indian investors through Q3 FY2026, compared with 1,970 petitions filed by Chinese investors.

- Rural projects continued to dominate among Chinese and Indian investors, while HUA demand is rising among the India market in FY2026. In contrast, investors from Taiwan, South Korea, Vietnam, and most other markets still predominantly selected HUA projects.

- I-526E adjudications continued to slow in Q3 while denials increased. USCIS adjudicated 904 I-526E petitions in the third quarter of FY2026, including 687 approvals and 217 denials. Quarterly adjudication volume in FY2026 remained well below the record levels observed in the second half of FY2025, while approvals continued to decline and denials increased.

- The I-526E approval rate fell to 76% in Q3. The quarterly approval rate declined from 94% in FY2025 to 76% in the most recent quarter in FY2026. Approval rates were even lower for Direct EB-5 I-526 petitions (31%) and legacy pre-RIA I-526 petitions (18%).

- The pending I-526E inventory surpassed 11,000 cases as of June 30, 2026. With filings continuing to outpace adjudications, 11,192 I-526E petitions were pending at the end of Q3, up 25% year over year. Meanwhile, the remaining pre-RIA I-526 inventory declined to just 960 petitions.
