Last week, USCIS published the quarterly statistics for the first quarter of FY2026, including the latest data on pre-RIA Form I-526 petitions as well as post-RIA Form I-526E (Regional Center EB-5 investors) and Form I-526 (Direct EB-5 investors) petitions. Key takeaways from our analysis of the Q1 FY2026 data include:
- EB-5 demand remained strong: A total of 1,765 investors filed their petitions in Q1 FY2026, representing a 12% increase from the previous quarter and a 24% increase year over year. Based on filing volumes, it is estimated that more than $1.4 billion in EB-5 investment was raised during the first quarter of FY2026.

- I-526E adjudications declined while denials increased: USCIS adjudicated 940 I-526E petitions during Q1 FY2026, a 34% decline from Q4 FY2025, when adjudication volumes reached a post-RIA record high. Additionally, USCIS denied 176 I-526E petitions during the quarter, causing the I-526E approval rate to fall to 81% — the lowest quarterly approval rate since the enactment of the RIA.

- Indian EB-5 investors led petition filings in Q1: With 668 investors filing petitions during Q1 FY2026, India surpassed China (649 filings) to become the largest investor market in the first quarter of the new fiscal year.

- Interest in rural projects continued to grow: Rural projects accounted for the majority of I-526E filings (56%) during Q1 FY2026. A total of 988 petitions were filed under the Rural Area category, representing a 21% increase from the previous quarter. This growth was driven primarily by a surge in rural filings from Indian investors, whose filing volume increased 70% quarter over quarter to 411 petitions in Q1 FY2026.
