Earlier this week, USCIS published the quarterly statistics for the fourth quarter of FY2025, including the latest data on pre-RIA I-526 cases as well as post-RIA I-526E (regional center EB-5 investors) and I-526 (direct EB-5 investors) petitions. Key takeaways from our analysis of the full-year FY2025 data include:
- Record Filings and Adjudications: FY2025 set a new high, with 6,660 case filings and 3,439 adjudications. Since the enactment of the RIA, it’s estimated that 14,500 petitions have been filed, while approximately 4,300 I-526E petitions have been approved. Overall, EB-5 investment inflow reached an estimated $5.3 billion in FY2025, bringing total post-RIA capital formation to nearly $12 billion and highlighting the EB-5 Program’s continued economic impact.
- I-526E Approvals Continue to Surge: USCIS approved more than 1,300 I-526E petitions in Q4 FY2025, representing a 30% increase from Q3, when approvals had already reached a post-RIA quarterly record.
- Growth Across Key Markets: Chinese and Indian investors account for 73% of total post-RIA filings, with rural projects representing 57% of these petitions. HUA projects continue to dominate other investor markets outside China and India. Furthermore, demand from Indian and Korean investors experienced triple-digit increase in FY2025, while growth from Vietnam and China remained strong and steady.
- Post-RIA Approval Rates: I-526E approval rates remain consistently high (94%) in FY2025, while direct EB-5 (I-526) approval rates dropped to 41%.
