A major provision of the EB-5 Reform and Integrity Act of 2022 (RIA) requires Regional Centers to undergo an audit from U.S. Citizenship and Immigration Services (USCIS) every five years. In the first two years after the law’s passage, we heard little about the nature of these audits – until April 2024, when it was announced that USCIS audits would begin.

The first wave of audits has commenced, and the information that’s trickled in provides a window into how the process will go. To discuss what we’ve learned, IIUSA and JTC are assembling a panel of EB-5 experts (including some of the first to experience a USCIS audit) that will break down the audit process and answer important questions, including:

  • Why are some Regional Centers being selected over others? Is there a method?
  • How long do Regional Centers have to prepare for an audit once notified?
  • What information is being requested by auditors
  • What do site visits entail?
  • What if a Regional Center is unable to accommodate a site visit or information request during the audit timeframe?
