The recently decided case of Battineni v. Mayorkas rejects USCIS’ long-standing interpretation of the “path of funds” requirement for EB-5 investors. Current USCIS policy for immigrant investors seeking green cards in the EB-5 program requires investors to “trace where every penny came from.” In this decision, the court rejected USCIS’s policy and held the only relevant issue is the immediate source of the funds used for the immigrant’s investment. Join IIUSA’s President, Bill Gresser, for a one-on-one interview with Ron Klasko, lead counsel in the matter against USCIS. President Gresser will sit down with Mr. Klasko at 3:00pm EST the afternoon on Monday November 25th. Hear from the source how this case was prosecuted and what it means for the EB-5 community.
Meet the Panelists:
- William P. Gresser | President, EB-5 New York State; President, IIUSA
- Ronald H. Klasko | Managing Partner, Klasko Immigration Law Partners
