Last week, Invest in the USA (IIUSA) kicked off its 2023 EB-5 Experts Webinar Series with a discussion on Reform and integrity measures put in place by the EB-5 Reform and Integrity Act of 2022 (RIA). While welcomed by the industry the integrity measures came with a host of changes the industry needs to be aware of and IIUSA was happy to provide an educational platform for all industry stakeholders.
Under the RIA, new commercial enterprises (NCEs) are now required to use an independent fund administrator to provide oversight and track the disbursement of EB-5 capital, and thereby improve transparency, security, and reporting compliance. An NCE can waive this requirement if the financial statements of the NCE and affiliated job-creating entity (“JCE”) are audited by an independent accounting firm.
