Recording Available: IIUSA Special Webinar – Battineni v. Mayorkas
On November 25, 2024, IIUSA hosted a special webinar about the recently decided court case Battineni v. Mayorkas and the recording is now available. The decision rejects USCIS’ long-standing interpretation of the “path of funds” requirement for EB-5 investors.
Current USCIS policy for immigrant investors seeking green cards in the EB-5 program requires investors to “trace where every penny came from.” In this decision, the court rejected USCIS’s policy and held the only relevant issue is the immediate source of the funds used for the immigrant’s investment.
IIUSA President Bill Gresser (EB-5 New York State) moderated a discussion with the lead attorney on the case, Ron Klasko, for an informational look at what exactly the decision of Battineni v. Mayorkas said and what it means for the future of EB-5 investors and their adjudications.
