The USCIS Office of Policy & Strategy published a report in July 2021, comparing the numbers of monthly Form I-526 filings before and after EB-5 regulations went into effect in November 2019.
Among other things, the key findings of this report include:
- USCIS received on average 366 I-526 petitions during the 12 months before the new regulations went into effect, while the number of monthly Form I-526 filings went down to 22 during the 18 months after the effective date of the new regulations, a drop of 94%.
- 3,248 EB-5 investors filed their I-526 petitions in November 2019 before the new rules became effective, a month-over-month increase of 369% from October.
- USCIS received 445 I-526 petitions in June 2021 when U.S. District Court for the Northern District of California vacated the new rules and the Regional Center Program faced a sunset date of June 30th.
