Based on the latest data published by USCIS for the fourth quarter of fiscal year (FY) 2024 (July 1 – September 30, 2024) on Form I-829 (Petition by Entrepreneur to Remove Conditions), we identified valuable trends in the final step of EB-5 investors’ immigration process.
Particularly, our analysis of the FY2024 full-year I-829 statistics highlights significant milestones in case filings and adjudications. The key findings in our report include:
- A record-breaking 4,152 I-829 petitions were filed in FY2024, marking a 255% increase from the previous fiscal year.
- USCIS processed over 6,400 I-829 cases, with 6,090 approvals and an impressive 95% approval rate, reflecting the highest-ever number of EB-5 investors successfully completing the final step of their immigration journey through the EB-5 Program.
- I-829 case processing time dropped below 40 months for the first time since FY2022, and
- The I-829 case backlog declined to 7,758 cases at the end of FY2024 despite historic case filing levels, thanks to the much-improved adjudication productivity at USCIS.
