Last week, the U.S. Department of State released the monthly Visa Bulletin for January 2024 (see here), unveiling substantial progress in the final action dates within the EB-5 “unreserved” visa category, particularly for Indian applicants.
Within the “unreserved” EB-5 category, the final action date for India is set to advance by 717 days in the upcoming month, landing on December 1, 2020. This represents the most significantly movement since fiscal year 2020. Additionally, Chinese-born applicants will also see a 68-day advancement, moving the final action date for China to December 8, 2015. In January, the dates for filing will remain unchanged from the December Visa Bulletin, standing on January 1, 2017, for Chinese applicants and April 1, 2022, for Indian nationals.
Within all three of the “reserved” EB-5 categories, all countries continue to remain “current” in the coming month.
EB-5 FINAL ACTION DATES (CHART A)
The January Visa Bulletin revealed the following final action dates for EB-5 visa applicants:
- Applicants associated with unreserved EB-5 visa categories:
- China: December 8, 2015 (68-Day Forward Movement);
- India: December 11, 2020 (717-Day Forward Movement);
- All Other Countries: “Current”;
- Applicants associated with an EB-5 project within the reserved EB-5 visa categories:
- All Countries: “Current”;

EB-5 DATES FOR FILING (CHART B)
In the “unreserved” category, dates for filing will continue to be “current” for all EB-5 applicants in January 2024, with the exception of the investors who were born in China or India. For these applicants, the dates for filing date will remain on January 1, 2017, for Chinese nationals and April 1, 2022, for Indian applicants. Eligible EB-5 investors with a priority date preceding the dates of filing can take advantage of the concurrent filing of their I-526E petition and application for adjustment of status.
In all “reserved” categories, there are no cut-off dates for applicants across the board.
