On Thursday, March 16, Invest in the USA (IIUSA) submitted a joint letter with the American Immigration Lawyers Association (AILA) urging USCIS to provide clarity and guidance on the EB-5 Integrity Fund fees, particularly in response to the March 2, 2023 Federal Register notice on the matter.
The letter, which can be read in its entirety below, outlines the statutorily intended purpose and implementation of the Integrity Fund fee per the EB-5 Reform and Integrity Act of 2022 (RIA) and where both IIUSA and AILA believe the agency has misinterpreted who is required to pay the fee and how much.
IIUSA would like to thank AILA for its continued partnership and alliance with IIUSA, especially on important matters such as this that effect the success and sustainability of the EB-5 Program. The EB-5 industry is strongest when we speak with one voice and we are grateful for partners such as AILA.
