Earlier this week, USCIS published the quarterly statistics for Q2, FY2025, including the latest data on pre-RIA I-526 cases as well as post-RIA I-526E and I-526 petitions.
Key takeaways from the latest data release include:
- Record-Breaking Demand for EB-5: Case filings in Q2 FY2025 reached the highest level since the enactment of the RIA, with a total of 1,918 investors submitting petitions in a single quarter.
- USCIS Adjudications Continue to Decline: Despite more than 10,000 post-RIA EB-5 petitions having been filed since the RIA’s implementation, USCIS has adjudicated only 1,620 cases as of March 31, 2025. In Q2 alone, just 208 I-526E petitions were approved, marking the second consecutive quarterly decline. This persistent gap between filings and adjudications has led to a rapidly growing I-526E case backlog.
- High I-526E Approval Rate: The approval rate for I-526E petitions remained strong at 94% during the first half of FY2025. In comparison, the approval rate for pre-RIA I-526 cases was only 72%.
