Last week, USCIS published the quarterly statistics for Q4, FY2024, including the latest data on pre-RIA I-526 cases as well as post-RIA I-526E and I-526 petitions. The latest data sheds light on trends in EB-5 demand, capital raising, case processing, and the backlog.
Our key takeaways from the latest data release include:
- I-526/E case filings in FY2024 reached the highest level since the enactment of the RIA, with 4,785 investors filing their petitions in the past fiscal year, an 83% increase year-over-year.
- The productivity of adjudicating I-526E and pre-RIA I-526 cases more than doubled from FY2023. Nearly 1,120 post-RIA I-526/E cases were processed in FY2024, and 5,896 pre-RIA I-526 petitions were adjudicated – the highest productivity since FY2018.
- The approval rate for I-526E cases remained very high in FY2024 (98%), while only 73% of pre-RIA I-526 cases were approved in the last fiscal year.
