Special pages were recently created so members can easily access developments related to the Behring v USCIS case and the EB5 Capital et al v USCIS case of which IIUSA is a co-plaintiff.
In late May 2022, IIUSA along with five Regional Center members filed suit against U.S. Citizenship & Immigration Services (USCIS) for its unilateral deauthorization of all previously existing EB-5 Regional Centers at the time of the enactment of the EB-5 Reform and Integrity Act of 2022 (RIA) in March 2022. In April 2022, Behring Regional Center filed a similar lawsuit on its own behalf. These cases have been pivotal in getting the Regional Center industry back to work after USCIS’s decision to deauthorize previously existing Regional Centers. While these cases are not yet closed, they did provide for a ruling by the Federal District Court for the Northern District of California to preliminarily enjoin USCIS from treating as deauthorized the previously designated regional centers based on its almost certainly erroneous interpretation of the Integrity Act.
As developments in these cases continue and more court filings are made, the Litigation Library will be updated.
