With USCIS publishing the latest quarterly statistics of all application and petition form types for the fourth quarter (Q4) in fiscal year (FY) 2022, IIUSA produced a comprehensive data report on the latest Form I-829 statistics for Q4 and full-year FY2022, analyzing the trends of I-829 case filings, adjudications, average approval rates, and the current I-829 case backlog at USCIS.

KEY DATA HIGHLIGHTS
Form I-829 Filing:
- A total of 1,270 EB-5 investors filed their I-829 petition in fiscal year (FY) 2022, a significant decline of 62% from FY2021.
Form I-829 Adjudication:

Immigrant Investors Program (IPO) at USCIS adjudicated 1,621 I-829 cases in FY2022, the lowest level since FY2015 with a year-over-year decline of 27%.

At its peak, the IPO was able to process more than 2,700 I-829 cases annually FY2018 and FY2020.
Form I-829 Approval Rate:

The average approval rate of I-829 petitions was 91% in Q4, FY2022, bouncing back from Q3 when the approval rate was 87%.
- Overall, the average approval rate of all I-829 petitions that were processed in FY2022 was 90%, remaining to be relatively high.
Form I-829 Backlog:

As of the end of FY2022 (September 30th, 2022), a total of 11,150 I-829 cases were still pending at USCIS, a decline of 3% from the last fiscal year.
