On Wednesday, January 12, 2022, IIUSA sent a letter to U.S. Citizenship and Immigration Services (USCIS) requesting the agency to continue its 2021 policy to not act on any pending immigrant investor petition or application dependent on the EB-5 Regional Center Program (re)authorization.
IIUSA and its counterparts within the industry and on Capitol Hill are confident in the progress being made towards Program reauthorization and feel assured that the Program will see an authorization in February. Accordingly, we continue to advocate for the protection of good-faith investors during this lapse.

RE: USCIS Alert – December 30, 2021, Reevaluating Decision to Hold EB5 Immigrant Investor Regional Center Program Applications
Invest in the USA (IIUSA) is grateful for the Citizenship and Immigration Service’s (USCIS) 2021 post-program lapse policy position to not act on any pending immigrant investor petition or application dependent on the EB-5 Immigrant Investor Regional Center Program (re)authorization.
Although IIUSA’s members are primarily regional centers the association fully recognizes that regional centers are only part of the EB-5 ecosystem and protecting good-faith investors is critical to the program’s success: for regional centers, for immigrant investors, and for regional and local economies.
Therefore, we respectfully ask USCIS to continue its 2021 policy not to act on any pending immigrant investor petition or application dependent on the EB-5 Immigrant Investor Regional Center Program (re)authorization. We, along with specific investor advocates and other EB-5 stakeholders, feel assured the Regional Center Program will be reauthorized. All parties are working assiduously with Capitol Hill staff toward this goal and are confident the public policy discourse will once again support the program and reauthorize its ability to create U.S. jobs.
