USCIS to Reevaluate Decision to hold Pending EB-5 Petitions During Program Lapse

On December 30, 2021, U.S. Citizenship and Immigration Services (USCIS) updated language on its website pertaining to the continued EB-5 Regional Center Program lapse and its impact on pending investors’ petitions. The agency noted that it is “reevaluating the decision to hold, or not act on, any pending petition or application” dependent on the statutory authorization that has been expired since June 30, 2021.

IIUSA is working with its government affairs team and other partners to determine what response may be necessary on USCISs update. The association’s continued priority is to secure the long-term reauthorization of the EB-5 Program as well as to protect all stakeholders from any harmful impacts stemming from the current lapse.
