On November 26, 2019 a complaint for injunctive relief was filled by Florida EB5 Investments LLC against the United States Citizenship and Immigration Services (USCIS) challenging the EB-5 Immigration Investor Program Modernization Regulations (the “Regulations”) which were published on November 21, 2019.
Per the complaint, the main issue ” is whether a federal agency – DHS – has the right to promulgate a regulation that changes the requirements for a statutory-based visa program while ignoring data demonstrating the harmful economic impact of such a rule.”
